To Whom it Concerns:

I am writing to you first and foremost as a parent and second as a former public school teacher in Utah.   I faithfully belonged to and supported the UEA the entire time I taught..  Today, I was sent an email from a friend. [Read it here.]   The letter was from the UEA and it was a request for its members to voice their support for the Common Core because of concerns being voiced by a “small vocal minority”. 

I would likely fit into that category.  It seems this emailwas an attempt to label, marginalize, and thus dismiss those who have voiced concerns or opposition.  I feel that my concerns, both as a parent and educator, are valid and are based on legal documents and lengthy research.  I am writing in hopes of working together. 

My experience has been that the large majority of citizens (including parents, teachers and administrators) are unaware of the big picture that comes with the adoption of the Common Core agenda.  It is so much more than a set of standards.  So, I would say that my experience has been that a large majority are silent on their like or dislike for Common Core.  Silence is not acceptance; it is most likely ignorance. 

I believe that as American citizens, we have a responsibility and a right to voice our opinions and to have questions answered and concerns addressed.    Unfortunately, this opportunity never happened with Utah’s adoption of common core.  Due process didn’t occur and the parents and teachers feel like a trust was violated.

I believe that Utah has some of the finest educators in the nation and my hope is to return educational decisions to the hands of parents, teachers and local administrators.   I don’t think the shift began with Common Core, but it is the current reform and parents and teachers aren’t happy now. The issues need to be addressed, not dismissed. 

Teachers have been told that “it will not bode well professionally to speak against Common Core.”   They have told me that they have been sent a clear message that they should not talk about their concerns –and definitely not while at school.  Local school board members are also being told to not speak out, and that they need to support the state board.

I am happy to meet and listen to your concerns and attempt to work together for a solution that is right for our state.

While we wait patiently together to see if the UEA has the inclination to respond to Renee, I have a few thoughts.   I happen to be waiting patiently, too, for a response to my letter to Governor Herbert (see below).   But visiting or writing letters to any member of  the education establishment results in either: a)  silence or: b)  a ridiculous pat on the head.   Anyone who’s tried, knows.
This happens over and over and over– not only at the Utah state level, but also at the local school board level, and at the federal (unconstitutional) Department of Education level.
It does not stop us from writing, calling, and going to as many of their meetings as we can stomach.
I believe in the squeaky wheel theory, and I believe in Jesus’ parable about the woman and the unrighteous judge from Luke 18.  If everyone who wanted Common Core to go away would call, write, and pray repeatedly, weekly, persistently, patiently, unceasingly Common Core could not stand.  No legs.
Why not?  Because Common Core has no legs –except expensive marketing networks and lies– to stand on.  It has countless millions of dollars gambled on this takeover of American schools as a “uniform customer base” and more millions spent on marketing its unsupportable talking points.
And that is the simple,  incredible truth.  No legs.
It has no academic pilot testing, no written amendment process for states to retain local control, no privacy protections for its tests’ data collection processes, no actual international benchmarking, no chance of improving “global competitiveness,” no heart, no wisdom, no love for classical education,  no state-led history,  no hope of developing a real love of learning; no common sense.

Remember the parable of Jesus from Luke 18:   There was in a city a judge, which feared not God, neither regarded man:  And there was a widow in that city; and she came unto him, saying, Avenge me of mine adversary.   And he would not for a while: but afterward he said within himself, Though I fear not God, nor regard man;  Yet because this widow troubleth me, I will avenge her, lest by her continual coming she weary me.”
There are people at the State Office of Education and at the State School Board who likewise “fear not God, nor regard man” yet because we trouble them, they may choose to “avenge” our cause, since by our “continual coming” we weary them.  And weary them we must because as a state, we are experiencing a huge Spiral of Silence.
Spiral of silence is the name of a well-studied communications theory by Dr. Elizabeth Noelle-Neumann, a phenomenon which happens when people fear separation or isolation (or job loss or even death) but perceiving or believing that they are in the minority, they keep their concerns to themselves.
Spiral of Silence theory arose as an explanation for why so many Germans remained silent while their Jewish neighbors were being persecuted in the 1940s.  Parents, teachers and legislators who do not know enough about Common Core and the Common Data Standards, and who are told to “support” them, do not feel comfortable arguing that we should be free of them.  The pressure is even more intense for state school board members and the UEA, which explains, in part, the repeated official stonewalling that we experience and the relatively low number of teachers and education officials who fight against the whole suffocating Common Core and Common Data Standards agenda.

But I will admit that I laughed out loud when I saw the “official” silencing response sent to me by a clerk from the governor’s office, in response to my letter last week to our governor.  I would have received the same email had I sent the governor my favorite potato salad recipe.

Thank you for your follow up email. I regret that my response was not satisfactory. We receive hundreds of email, letters, and calls daily and aim to make sure every constituent gets confirmation that their correspondence was received and that their opinion is taken under consideration.
Common Core is a very important issue and the Governor is paying close attention to the feedback, opinions, and concerns he is receiving from constituents all over the state. While I appreciate the fact that you are responding, I still request a substantive response from someone at the Governors’ office.  Noting that the Governor “is paying close attention” is not a response to the issues I raised but merely an acknowledgement that I wrote at all.
Please, forward my email, and the other emails you have been receiving, to those in office who are responsible to the people for these decisions.  Perhaps the lieutenant governor has more time to answer specifics than the governor?
Constituents deserve real answers, not pats on the head and thank yous for simply writing at all.

I  am patiently waiting to see if anyone at the Governor’s office or anyone who I copied the letter to at the office of education has the time to respond with substance.

Meanwhile, I sent a form of the same letter to the Daily Herald.    My state school board representative, Dixie Allen, decided to respond.  Dixie Allen’s response at the Daily Herald did not address my concerns although it was long.  It said that she was one those responsible for bringing Common Core to Utah, and she defended that decision.   I remain unanswered, by deafening silence by both the Governor’s office and my state school board representative, on these issues:
  • 1) Why are parents denied the right to opt children out of the state longitudinal database system (SLDS)  which tracks them almost for their entire lives without parental consent?
  • 2)  Why has there been no freedom of conscience, no open debate among educators when it comes to Common Core?
  • 3) How can we maintain the reins of local control of education when we are attached like siamese twins to the will of the D.C. groups that control Common Core?
  • 4)  Why doesn’t Utah have her own standards, instead of copyrighted standards coming out of unelected D.C. groups?
  • 5) Why has Utah agreed to Common Education Data Standards (CEDS) which align our private data with federal data standards?
  • 6) Why doesn’t Utah look to the example of South Carolina’s and Oklahoma’s governors, who have decried the Common Education Agenda, and get Utah out of it, as those states have so wisely, so importantly, done?

Please make some time and join me and other teachers and parents this Thursday in Salt Lake City as we simply show up to show that we are aware of what is going on in education today.  We will attend the open state school board meeting.  Some of us will speak at the 2 minute public comment segment.  Most of us won’t say a word.  Please, just show up.  That day, they are to decide whether or not to renew the federal NCLB waiver which Utah received in part as a reward for agreeing to do Common Core instead of NCLB.
If you can’t be there, please DO SOMETHING ELSE.  There is so much we can do.   Here is the Utah State School Board’s address: board@schools.utah.gov.  We can write or call the board, the newspapers and t.v. stations. We can politely and persistently pester our governor: 801-538-1000 or 800-705-2464 (Utah’s Governor Herbert’s number). There are many Stop Common Core rallies happening now in Utah, Missouri, Louisiana, New York and elsewhere.   The rallies come on the heels of a U.S. Senate resolution that denounced Common Core, signed by senators from South Carolina, Utah, Texas, Oklahoma, Iowa, and Wyoming.

Tonight, Tuesday, February 18th, at 6:30 at the State Capitol Building, Hall of Governors,  is the Utah Stop Common Core rally.   As the press release indicated, this is an action rally that sends a message to Utah legislators:  “Stand up against Common Core or prepare to be voted out of office.”

Please, Utahns, come.

We need many hundreds of people here tonight.  Your physical presence speaks more loudly than many other things.  There is a battle going on, involving your children and their well-being.  Drop your laundry folding and your soccer game and your genealogy club meeting and come; defend.  I’ll tell you why.

If you care about liberty and local control, if you care about what your children will be learning in school and you want a voice in that, if you care about teachers being given respect and not micromanaged by an increasingly top-heavy government, if you care about the privacy of student data, if you think that classic literature should remain in schools, not edged out by “informational texts” down to 70% by the senior year, if you think that children should have access to calculus and other higher level math classes if they want to learn it, in high school; if you think traditional math algorithms are more valuable than group discovery of math pathways, if you believe in the U.S. Constitution’s guarantee that states, not federal forces or corporate boardrooms, should be directing schools; if you believe in the Declaration’s guarantee that innocent people will not be subjected to “unreasonable search and seizure” to which the educational SLDS tracking system does subject all schoolchildren; if you think schools should be using educational standards that are un-experimental, time-tested, and actually analyzed and vetted locally prior to adoption; if you want to send a message to the state school board and governor that we don’t want national sex standards, national social  studies standards, and national science standards which are waiting in the wings to join our current math and English national standards;  if you want to send a message that you believe in representation and not in having unelected corporate boards and untransparent, unelected groups like the CCSSO and NGA making decisions for US that we cannot alter; if you want to see independent thought and not just groupthink taking over the textbooks of our state and nation; if you believe in the principle of honest debate rather than profiteers paying for their version of reforms without the debate of the people ever happening; if you think education reforms should have something to do with parents and teachers rather than with bureaucrats and corporate partners— then COME TO THE RALLY TONIGHT.  GOD BLESS YOU FOR COMING.

Utah Mother of Seven Alisa Ellis to Speak This Week in Kansas and Wyoming About Common Core   3 comments

My concerns about the academic merits of Common Core paled in comparison to the much larger issue of the loss of freedom and the stripping away of local control – Alisa Ellis

Picture a bread-baking, fun-loving, church-going, small-town mother of seven –who was never politically active, who never even used to vote, –picture her becoming a sudden political activist who now travels across Utah and to other states to speak to live audiences, radio audiences, and on t.v. about the Common Core Initiative. Let me tell you a little bit about Alisa Ellis, a woman whose motto is, “I do not live in fear.”

To Alisa, education had always been important. She and her husband liked to say that they were proudly raising a family of nerds. They were the kind of parents who volunteered in the classroom. They were the kind who paid attention.

But their introduction to the educational transformation of America known as Common Core came in 2011, long after the initiative had been adopted by the state. (2011 is a whole year after the Utah state school board adopted Common Core without public knowledge or vetting; and it was two years after the state had agreed to accept the federal $9.6 million to create an “SLDS” student tracking database.)

Alisa received a Common Core pamphlet at a parent-teacher conference.

She stared at it. She puzzled. She asked the teacher to explain.

“I didn’t know how one size-fits-all would work without hurting the top and bottom students,” she recalls. But when she asked the teacher to expound on the subject, that teacher didn’t know anything.

Alisa began to ask around.

“I asked everyone I knew for their thoughts on Common Core. I tried researching online but everything was fluff,” she said, “It was nine months before I was invited to a meeting to learn more.”

One day at the grocery store, she bumped into a friend who actually knew something about the Common Core Initiative. The conversation lasted a long time. The friend invited Alisa to come to a “Cornerstone of Freedom” meeting to learn more. The friend added, “Oh, and would you make a few comments?”

Alisa thought that meant that she should raise her hand and make comments. She found out, during the meeting, that she was an actual scheduled speaker– after the other speaker.

“I saw my name on the schedule and immediately panicked. I pulled out my tablet and started researching ‘What is Common Core?’ After a few minutes, I realized it was pointless and I would be better off just sharing my concerns.”

She told the audience of her concerns which had begun with the Common Core pamphlet at the parent/teacher conference. She told the story of another meeting, a gifted-and-talented informational meeting, where the director said that next year, teachers would ‘start digging deeper.’

(“Digging deeper? That same line was repeated so many times that I knew I was being fed something,” she explained.)

She also told the audience another story: a school guidance counselor had advised her to take her son out of AP history. The counselor had said that her son’s “career track was more along the lines of engineering.”

He’d said, based on Alisa’s son’s ACT practice test, that: “clearly your son isn’t going to be a history professor, so we should pull him out of AP world history and put him in a class that follows his career path.” Because Alisa had trusted the system, she hadn’t questioned the counselor’s advice so she pulled her son out of AP history. This was a decision she later regretted.

Alisa started digging more deeply into the whole Common Core Initiative. She read the state’s Memorandum of Understanding with the developers of the Common Core. She read the Cooperative Agreement. She saw how the State Longitudinal Database System intertwined with the academic standards and tests. She read speeches by secretary of education Arne Duncan. She read the No Child Left Behind documents and waivers. She read the implementation manuals that were sent out to governors to tell them how to promote Common Core. She read documents by Achieve, Inc., the group that helped create the standards for the copyrighters. She could hardly believe that the Common Core’s takeover of local control was out in the open, yet unknown by virtually everyone who ought to know about it.

My concerns about the academic merits of Common Core paled in comparison to the much larger issue of the loss of freedom and the stripping away of local control,” she said.

She went with her friend, Renee Braddy, to meet with local teachers, principals, local school board members, the community council, and the local superintendent to discuss Common Core. These discussions resulted in the opportunity to make a presentation at the local school board meeting. (That presentation was filmed, and is called Two Moms Against Common Core on YouTube.) The superintendent had asked them not to film their presentation, but since it was an open, public meeting they did anyway. The video was shared around the state and ignited a firestorm of activists to stand up and fight against Common Core. I was among the people who got to see Alisa and Renee’s video the first week it was posted.

Next, Alisa decided it was time to become more active. She became the county delegate to the Republican convention, and before the convention, she started making phone calls to find out which candidates were promoters of Common Core. She found that all the candidates running for national level seats were opposed to Common Core. All the local candidates, aside from the current Governor, were also against it. (Governor Herbert was undecided at the time.) However, the candidates running for state legislature seats were less willing to take a position.

With unflinching determination, she successfully set up two face-to-face meetings with Governor Herbert to discuss Common Core. Then she organized public meetings and helped bring in expert academic witnesses to meet with legislators; she started her blog called Common Core Facts, she repeatedly attended and spoke up at state school board meetings, and she co-founded Utahns Against Common Core with a handful of other Utahns. (That website and petition “Utahns Against Common Core” today has over 8,000 signatures.)

Alisa’s actions, along with other activism happening around the state, eventually helped push Utah’s leadership to agree to withdraw from the SBAC Common Core testing consortia. It was a chink in the seemingly impenetrable armor of Common Core. (Side note: after Utah bowed out of SBAC, other states also began to withdraw from SBAC and PARCC. Sadly, Utah’s state school board subsequently chose to use another Common Core testing entity, AIR, which is partnered with the same SBAC. –But that’s another story.)

From the beginning, Alisa began to get invitations to speak across the state and then from other states. Today, she has probably given over fifty speeches on the subject, in tiny places and large venues, both with other speakers from Utahns Against Common Core and on her own.

This week, she will be speaking in Jackson Hole, Wyoming and in Merriam, Kansas.

Parents at today’s rally provided the photos that documented the rally.

Joseph Rella’s phone message to the parents of his district went viral within hours of its release. That message is quickening the rate at which the truth about Common Core is seeping out past the Common Core facade, despite federal promotion and despite millions of marketing dollars that Bill Gates has spent pushing the agenda on businesses, teachers, the PTA, politicians and the general public.

For those who want to get involved: a strong parent-led movement called Stop Common Core in New York State has planned a public forum for next month, which is free and open to all interested attendees.

The parent-led movement emphasizes the fact that this is not about being on the Left or the Right of the political spectrum. In fact, the Stop Common Core in New York State website opens up with a red, white and blue graphic that says, “It’s not about Left or Right. It’s about Liberty.”

Stop Common Core in NY’s forum in September will include a variety of speakers from CATO Institute, Pioneer Institute, American Principles Project, Seton Hall University, Education New York, and parents/teachers:

Dear Alpine School District Board Members,

I want to thank you for being willing to listen to the public last night and I appreciate the board even being willing to offer a few answers and some clarifications. I realize that many of you were in a very tough spot and that it isn’t easy to be involved and put yourself out there for possible public ridicule. I appreciate your service and the time you devote.

Like I stated when I spoke last night, I honestly believe that the Alpine School Board consists of leaders who have the ability and wherewithal to push back against the federal government and state’s top-down control over education. I think this will give other districts and states the courage to follow, if you are willing to ask the hard questions and encourage the discussion to happen. The federal top-down control over education isn’t a new thing that is happening with just this administration, this has been happening for decades in America. Honestly, I don’t really care who started it, I just want to know who is willing to be a part of stopping it.

I feel that as Americans we not only have a right to be involved in govt., we have a responsibility. We must protect the blessing of freedom that this nation was founded upon. When we see things happening in government that are not in-step with what we believe is best for ourselves, our families, and our communities, then I believe the public has the responsibility to hold their feet to the fire so they can be accountable. This should be happening at a federal, state, and local level.

It is no small task for people to attend a board meeting, especially with small children and the many obligations that are demanding of our time. I was actually very surprised by the large crowd in attendance last night. I know that they represent a very small percentage of the many, many people who are concerned about the nationalization of education that is happening through the Common Core Agenda. This is education without representation. It has been my experience as I have spoken to people that a very large majority of the people in this valley still don’t have a clue about what is happening in education, nor have they ever even heard the words “Common Core”. Silence is NOT acceptance, it is most likely ignorance.

As elected officials who have the responsibility to represent the concerns of your constituents, I hope you are willing to do your homework and ask the hard questions of the state school board and governor. Study the NCLB Flexibility Waiver and the RTTT application. This is what has helped me realize that the standards are a very tiny piece in a HUGE educational reform agenda. Our president and his administration have been very vocal about wanting a “cradle to career education” reform agenda. I am well aware that UT did not win any money from their RTTT application and we are not bound to any of those obligations that we committed to, but ironically enough, we are still implementing them. Therefore, it is still worth your time to study what UT was willing to do in order to get their share of the ARRA $.

This is serious and I believe that we are writing American History. We need to be very vigilant and realize that this isn’t just the next trend in education that will pass. Nationalizing education creates a centralization of power. This will lessen, if not completely remove, teacher and parental input. This is in direct violation with our US Constitution as well as our Utah Constitution.

When we stray from the principles of the Constitution and the Bill of Rights which were intended to limit the power of government and promote independence and liberty, then we are disregarding the very document that defines us as being an Americans and this will result in our nation ceasing to be America, the “land of the free and the home of the brave”. This whole agenda consisting of: national standards, national tests, data collection, teacher accountability systems, and the turn-around schools model should be rejected by those who value LOCAL CONTROL and PARENTAL INPUT. We do NOT need or want a top-down approach to education where we have to get “approval” from the federal government or any other unelected bureaucrats.

It is concerning to me that we have not already rejected being a part of national experiment at an unknown cost financially and a high cost to freedom. From a teacher’s perspective, I believe that the truth is that we have no idea what curriculum our children will be taught under Common Core because the tests haven’t even been released. Tests dictate curriculum. As John Jesse from the USOE said at the Alpine AIR meeting, “it’s a sad fact, but they do”.

This is the reason why many, many people rallied at the capitol years ago when there was bill that would push for home schoolers to take state-mandated tests. Whoever writes the test will essentially dictate what is going to be taught, especially when teachers merit pay and/or jobs are being based upon student performance on these tests. We have three federal laws prohibiting a national curriculum in the US and yet this is exactly what is happening through the creation of national standards and federally funded national tests with publishers criteria and curriculum models. It is no wonder that the key players including the CCSSO didn’t want to go through the US Congress, they knew they would reject it, the same way they rejected national history standards in 1995.

I could go on and on, but I am requesting that you to please do your due diligence. I would like to know each board members position and thoughts on where you stand currently on this whole educational reform package including the CC standards?

Also, we will be presenting on Thursday evening in Saratoga Springs from 7-9 pm in the clubhouse at Talon’s Cove Golf Course: 2220 South Talons Cove. We would love to have you and anyone else that may interested attend, if possible. Also, if there is someone who would like to speak for Common Core, please let me know and we will add you to the program.

The Need for Parental Empowerment in Education: From Renee Braddy   8 comments

The comments and stories below were written by Renee Braddy (dark hair, the mom the middle of the three moms photo above)

   “Last year I was at my daughter’s elementary school when I overheard a conversation between a family and the principal.  This family’s kindergarten son had qualified for all-day kindergarten.  And, let me say that qualifying for this so called service of all-day kindergarten is a JOKE!!!  I cannot emphasize that enough.  I watched and listened carefully as my daughter was administered the same test.  I was actually asked by the teacher administering the test to wait in the hall while the test was given.  As a former teacher who is greatly opposed to parents being left in the dark and as an involved and curious parent, I requested that I be allowed to just sit in the corner.  Pathetic!

This boy was from a family that I’m assuming spoke English as their second language.  I heard the father translating questions from the mother to the principal.  The first question was, “what time will he have lunch?”

The next question was, “how long does his lunch last?”

The last question that I heard was the father asking, “Can his mother come and get him from school to bring him home to have lunch with her?”

It broke my heart.  Here were parents who wanted to have their child home and yet felt obligated to have him in school all-day based on a very poor assessment.  I could tell that they sincerely wanted to do what was best for him.

   I wanted to scream at the top of my lungs, “don’t do it!  You DON’T HAVE TO SEND HIM TO SCHOOL ALL DAY!  You are his parents and YOU can offer him SO MUCH MORE.”

The hardest part for me was the end of the conversation when the principal answered the question about whether or not this boy’s mother would be allowed to have her son come home for lunch each day.  The principal seemed perplexed and stammered for a minute and then said, “well, ummmm, you are the first person that has EVER asked me that.”  He then thought for a bit longer and said, “I think we could probably arrange for that to happen.”

I couldn’t help but think, “Are you kidding me?  Why do parents have to ask for permission to do what they feel is in the best interest of their child?  Do we even understand that we have choices and that we are not obligated to send our children to all-day kindergarten or to school at all?”

   Have we really come this far in society that we don’t understand that we are the parents and we as such God has given us stewardship over our children?

2.      I have a nephew that didn’t speak a word until after his fourth birthday.  He would have easily qualified for government funded preschool.  Fortunately, he was the fifth child and his parents had gained experience and wisdom.  His mother kept him home with her and taught him and worked with him and when he began to finally speak, he spoke in full sentences and is now in 4thgrade and  at the top of his class.

I have a friend who does very well financially and her daughter qualified for government funded preschool at the age of two because she didn’t speak.  I said to her,“are you kidding me, wouldn’t that be every 2 year old?”

She said, “I know, I just figured that if they were offering the service, I would take advantage of it, then I wouldn’t have to get a babysitter while I go to the gym.”

Unfortunately, this is the mentality of far too many parents.  We have come to not only accept these so-called services, but many actually expect them.

I am sure you are hearing from very qualified well-intentioned individuals who are so-called experts in educating children.  I know because many of them were my professors and colleagues when I taught school.  I was shocked when I saw Dr. Nancy Livingston, whom was one of my BYU professors at BYU testifying to the importance of the state board adopting preschool standards.

Although, I have respect for these individuals, I do not think they have a deep appreciation for freedom and liberty.  When I went to talk to my former principal in Provo about concerns that I have with Common Core, she asked me what I was really concerned about.  I told her that I believe we are heading down a path towards socialism.

She shrugged her shoulders and said, “like Canada and Australia”.  She wasn’t concerned.

I then said, “I am worried that if we can nationalize education and make all the standards common, what’s keeping us from mandating equal funding to education?”

She said, “I would love that, wouldn’t that be great!”

I asked her, “Where will the money come from?”

She said, “I don’t know, but wouldn’t that be great, I would just love to have the resources that other states have.”

I was blown away and had to excuse myself as I knew we were too philosophically unaligned to have any further meaningful discussion on the matter.

In my opinion, we need to give the responsibility of being a parent back to the parents.  I believe that this would be the best service and gift that we could give to children.

I would love to talk to you further about this.  Again, I don’t claim to be an expert, but I DO NOT believe the statement, “those that start behind, stay behind.”  THIS IS SIMPLY NOT TRUE!

Children are not machines or robots, they are individuals and their needs vary.  We cannot put them into these so-called High Quality Preschools with a ratio of 1:10 or 1:20 and expect to solve society’s problems.”

What’s Going On With Utah Parents for Educational Freedom?   Leave a comment

    What’s going on with so many Utahns joining the fight for educational freedom, the fight against a federal “Common Core”?

When we signed the petition –along with over two thousand, so far, who have signed the petition at Utahns Against Common Core– what were we asking for?

In short:  higher, more constitutionally based (state-not-federally-controlled) educational standards.

  • We have asked the Governor, State Board of Education, and State Superintendent to take the steps necessary to rescind Common Core adoption, the Race to the Top application, the No Child Left Behind waiver, the use of SBAC/PARCC federally monitored testing and data collection,  and all other requirements upon the state that are related to these, and return Utah to higher, independent, non-federal education standards.
  • We have requested the Utah Attorney General in conjunction with the Federalism Subcommittee of the Constitutional Defense Council, to review all documentation related to such applications and contracts as mentioned above to ensure our state sovereignty is held inviolate. We further requested that this review of programs, documents, and applications, include an examination to ensure no private or personal information about students is transmitted outside of local schools and districts, despite the U.S. Dept. of Education’s and Utah Data Alliance’s efforts to the contrary.
  • Because the Utah State Board of Education adopted Common Core State Standards before they were even finalized, failed to perform a cost analysis related to statewide adoption, and failed to hold public meetings where citizens could review the actual standards prior to adoption, we have asked that a liberty-minded, academically solid educational committee (not the USOE or USSB) be authorized to rewrite Utah’s current standards through a well-developed and transparent process that includes numerous public hearings and input from committees that utilizes knowledge-based, academic, clearly worded, grade-level specific, measurable standards from other states (such as liberty-minded  Texas, Virginia and the impressive pre-common core Massachusetts) as models.
  • We want to give individual schools and districts full local control with the ability to adopt their own high standards, assessments, and research-based curriculum to encourage and allow for greater parental participation in the education system.
  • We aim for legislators and citizens to develop a 5-year plan to get Utah off all federal funding of education, and if the federal government threatens to pull non-education related funding away from the state as we pursue this course, that this knowledge should be made public and fought with the assistance of the state Attorney General.
  • We have asked legislators to craft laws that will strengthen privacy rights and parental consent rules, and make sharing of personal student data with any state or federal entity a crime both for the one disseminating and the recipient who requested personal information.

State School Board Meeting Today: To Bare Or Not To Bare Private Student And Family Data For Feds?   1 comment

Dear Board,

I am writing to second Renee Braddy’s attached email.  As you are aware, a lawsuit is in full gear right now between the Department of Education and the Electronic Privacy Information Center, which alleges that the Department of Education overstepped statutory authority by redefining terms and loosening parental consent law in the federal FERPA regulations; remember, federal FERPA laws have not been altered by Congress.  Nor has state FERPA law been altered.  These oversteps by the Dept. of Education are illegal under GEPA law and under the U.S. Constitution.

If the Utah board supports this illegality, they will be held accountable under the Utah Constitution as well.

More importantly, the core issue here is that student privacy, a civil right, is being shoved aside to further empower federal and corporate forces in the nonconsensual access to private academic and nonacademic data.  Let’s do the right thing.

Dear State School Board Members,

I just reviewed your agenda for today’s meeting and I amvery concerned about the action item regarding data.  On line 213 where the document is referring to studentinformation, it reads that it will be released in accordance with the FERPA, 34 CFR 99-31.  This is the new regulation that went into effect Jan. 3, 2012 and was written by the US DEPT of ED and DID NOT pass through the US congress.  This regulation is currently being challenged by EPIC in a lawsuit.  Ithink it would be wise to have our children’s data dispersed in accordance withFederal LAW 20 U.S.C. § 1232g, not the regulation.

There are LOTS of concerns with this new regulation and I believe it would be a BIG mistake to pass this rule change without further study.  Please DO NOT vote for this, but rather please table the item for further discussion.

I have extensively study the new FERPA regulation due to anincidence in Wasatch County.  This new regulation literally turns the FERPA law on its head and DOES NOT protect our children’s personal information.  This is a very serious matter.

It further states online 216 that such responses may (not SHALL) include:

1. de-identified data

2. agreements with recipients of student data where recipients agree not to report or publish students identities (the way I read this is that this is personally identifiable student data– otherwise there wouldn’t have to be an agreement to protect it, right?)

3. release  of student  data,  with  appropriate  binding agreements,  for  state  or  federal accountability or  for  the purpose  of  improving  instruction to  specific  student (this would mean that personally identifiable student data is being released with parental knowledge).

188 A.  The USOE may provide limited or extensive data sets

216 99-31(a)(6); such responses may include:

217 (1)  individual  student  data  that are  de-identified,

218 meaning it is not  possible to trace  the data to individual
